CUSTOMIZED PRODUCTS AND CONFIGURATIONS

Where a customer requests customized equipment, the customer is responsible for providing accurate requirements and technical information.
Once a customized order has been approved and production or procurement has commenced, cancellation or modification may be subject to additional conditions or costs.
Any customized specifications will be confirmed with the customer before the order is finalized.
PAYMENT
Payment terms will be specified in the applicable quotation, invoice, purchase order, or sales agreement.
Depending on the transaction, payment may be required:
- In full before dispatch;
- As a deposit with the balance payable before shipment;
- According to an agreed payment schedule; or
- Under other written payment terms agreed between the parties.
Products will not be dispatched until the applicable payment requirements have been satisfied.
DELIVERY AND SHIPPING
Delivery timelines provided by Zadtex Petroleum are estimates unless expressly confirmed as guaranteed in writing.
Delivery may be affected by:
- Product availability
- Manufacturing or procurement schedules
- Shipping arrangements
- Customs clearance
- Transportation delays
- Weather or other unforeseen events
- Import/export requirements
- Events beyond our reasonable control
The customer is responsible for providing accurate delivery information and any documents reasonably required for shipment.
Where applicable, shipping, customs duties, taxes, clearance charges, and other destination-related costs will be identified in the quotation or sales agreement.
INSPECTION UPON DELIVERY
Customers should inspect equipment and packaging as soon as reasonably possible after delivery.
If there is visible damage, missing equipment, or an apparent discrepancy, the customer should notify Zadtex Petroleum promptly and provide relevant supporting information, including photographs where appropriate.
Failure to report an apparent issue within a reasonable period may affect the ability to investigate or resolve the matter.
INSTALLATION AND OPERATION
Fuel dispensers and petroleum equipment are technical products and should be installed, commissioned, maintained, and operated by appropriately qualified personnel in accordance with applicable laws, regulations, technical requirements, manufacturer instructions, and safety procedures.
Zadtex Petroleum is not responsible for damage or malfunction resulting from:
- Incorrect installation
- Improper operation
- Unauthorized modification
- Negligent use
- Failure to follow installation or operating instructions
- Use outside the specified operating conditions
- Improper maintenance
- Use with incompatible fuels or systems
- Unauthorized repairs
Customers are responsible for ensuring that their installation and operation comply with applicable local requirements.
WARRANTY
Where a product is supplied with a manufacturer’s warranty or Zadtex warranty, the applicable warranty terms will be provided with the product or stated in the relevant quotation or sales agreement.
Warranty coverage may be subject to:
- Proper installation
- Correct operation
- Regular maintenance
- Use within specified operating conditions
- Use of compatible fuel and components
- Compliance with applicable instructions
The warranty does not normally cover damage caused by misuse, unauthorized modifications, accidents, improper installation, normal wear and tear, or external factors outside the applicable warranty terms.
For warranty claims, customers may be required to provide the product model, serial number, purchase information, description of the issue, and supporting photographs or documentation.
RETURNS, CANCELLATIONS AND REFUNDS
Returns, cancellations, and refunds will be handled according to the applicable quotation, purchase agreement, warranty terms, and applicable law.
Because certain fuel dispensing equipment may be ordered, configured, or procured specifically for a customer, customized or special-order products may be subject to different cancellation and return conditions.
No return should be made without prior written authorization from Zadtex Petroleum.
Where a refund is approved, the applicable refund method and processing period will be communicated to the customer.
Nothing in these Terms is intended to exclude or restrict any rights that cannot lawfully be excluded or restricted under applicable law. Kenya’s Consumer Protection Act provides statutory protections for consumers, including implied quality/warranty protections in applicable consumer agreements.
